Greatings,
I hope everyone had a safe and enjoyable holiday
and that 2007 will be a very
prosperous year for you and your family. I am
very fortunate to live in
Frisco and be surrounded by so many good people that
care about their community.
I hope to finish my last term on Council the way I
started it, full speed ahead
and firing on all cylinders until the last
day! This year will bring a lot
of change for me personally, but it will also bring
a lot of change for Frisco.
In May, Frisco Citizens will elect two brand new
Council Members. The
Frisco Charter specifies that Council Members can
serve a maximum of two terms
of three years each. I was elected to office in May
of 2000. Now, those of
you who are sharp at math probably figured out my
years do not add up :-)
Actually, I was first elected when our terms were
limited to three and the length
of each term was only two years. Due to the charter
election of 2002, I was
"caught" in the middle and received one
additional year.
All current sitting Council Members and our Mayor
are at term limits.
By 2009, there will be a complete turnover of the
current Mayor/Council. If you
look on the left side of this newsletter, you will
see when each term expires.
On to other stuff. I have been lax in
communicating the current status
of the S.H.121/Tolling issue. Frankly, the details
are still sketchy and it is a
very complex issue that is difficult for me to cover
in a newsletter. In
short: As of December 1st, the Denton County portion
of S.H.121 is now fully
operational as a Tollway. Cash is NOT accepted on
this section; only tolltags.
However, if you drive it without a tolltag; you will
simply get a bill in the
mail (at a higher rate). I don't agree with
this method for several
reasons. Just think of all those people who recently
sold cars and the titles
have not yet been transferred. You will have to deal
with receiving a bill in the mail for a car that you
may have just sold.
Also, the out-of-state policy has been all over the
place. At one point, I
heard that if you car was not titled in Texas, you
would simply be able to use
it for free. Another time, I heard the policy
was that out of state
vehicles could not use it at all and would be
ticketed. I'm not sure where
we stand on this. I do know that the TTC and
TxDOT are accepting bids on
the sale of that section of highway to a private
company.
For the section from the Dallas North Tollway to
State Highway 75 in
McKinney; the status is still up in the air.
The decision has been made by
the TTC, TxDOT and the RTC that it will be a
Tollway. This was done against the
wishes of Frisco. The cities of Allen, McKinney
and Plano along with the
County passed resolutions that only supported a
Tollway under certain
conditions. Those conditions were not met and thus,
it is being tolled against
their wishes also. I have not kept up with any
recent resolutions by any
of those entities; so it is best to check with them
if you want their up-to-date
position.
Most of you are aware that I opposed tolling S.H.
121 from day one.
While I am not opposed to tolling roadways under
certain conditions; the tolling
of S.H. 121 is being done for all the wrong reasons
(in my humble opinion).
The section from DNT to Hillcrest road was already
designed and under
construction using gas tax dollars. Also,
Right-Of-Way was provided to
TxDOT by private companies with the expectation that
the road was a freeway. The
City of Frisco also gave ROW, which at times was
purchased using local taxpayer
dollars, for the future freeway. To turn around and
simply sell that to a
potential foreign company is simply wrong. To
me, this is a case of double
and triple taxation. I also do not agree that
tolling freeways as a mass
means of building new roads is the answer to the
transportation problems.
The ramifications of selling off public roadways to
private entities for 50+
years is not smart public policy in my
opinion. I do not believe it will
solve our transportation problems and, in fact, it
will create additional
problems in the future. It is a very short sighted
attempt at a quick fix.
I also do not support in any form or fashion selling
off our roadways, period.
Promising a rate of return, having variable toll
rates for peak/off peak and
annual escalations tied to an index are all very bad
ideas for taxpayers and
citizens of our area and Texas as a whole.. As
of now, the firms that have
submitted a bid for the CDA for S.H. 121 include
Skanska BOT, MacQuarie
Infrastructure Group, Cintra, Texas Toll and Power
and Pioneer Heritage
Partners. Also, putting the burden of numerous State
Roadways on what is
perceived as a wealthy County is unfair and is along
the lines of Robin Hood for
the School Districts.
I do not want this message to come off as at
attack on any entity. In fact; I
believe that all the players are simply doing the
best they can to address
certain problems. TxDOT has been great to work with
over the years. The
partnership has helped us get roads built as a team
in our area. The engineers
and directors at the local level have worked well
with Frisco in the past. The
Policy of tolling starts at the top; so your elected
officials need to be held
accountable. TxDOT and TTC are agencies charged with
building the roads in
Texas.
As I mentioned, this issue is very complex and I
only touched on a very small
portion of it. There is no easy answer and,
unfortunately, the deal is
pretty much done. I meant to start this update
as just that, an update on
the status, but I always get swept up into the
inequities of what is happening
when I start talking about S.H. 121. I should just
avoid the subject :-)
I know I am starting to sound like a broken
record, but turn them off (that
will be the 2007 battle cry). There is
absolutely no reason to have your
sprinklers running right now; we have received
enough rain to last through the
month of January. It is so frustrating to see
sprinklers running during
rainfall or the day after. We need to allow
the lakes to recover. On
the good news front; Lake Cooper was re-opened to
North Texas Municipal Water
District this last week. We are now back to drawing
water from Lake Lavon and
Lake Cooper. Our Director of Public Works, Gary
Hartwell, tells us that we
should be able to draw on it for the next couple of
months or longer if we get
additional rain fall. Through yesterday, Lake
Lavon levels increased 15"
and Lake Cooper increased 4'. You will
notice I installed a lake
level box on the left side (for Lake Lavon).
Keep praying for additional
rain. Also, another thanks to Jeff Trykoski
for wonderful Christmas Display at his home and at
City Hall/Frisco Square. Thousands of visitors,
many from out of state, came to see his work of Art.
On top of the great entertainment, Jeff managed to
collect 2,362 pounds of food and personal hygiene
products for Frisco Family Services! If you see Jeff
or his wife Bridgette, thank them for a job well
done.
Also, the last News Letter had a lot of
bounced/returned e-mails. That typically happens
when something in the newsletter triggers a spam
filter at your ISP or domain. For example, FISD was
triggered by the last newsletter. I try and deal
with these problems as they crop up. If you ever see
you missed a version of the newsletter, simply send
me an e-mail
and I will get it right out to you. The last one
that went out was V2N34 sent on 12/30/2006. As
soon as I get around to it, I will get these
newsletters posted on my web site.

Daddy Daughter Dance |

The 11th Annual Daddy Daughter Dance is one of
the Frisco's Premier Events

New Calendar |
| |
With so many events going on in our City, I am
toying with the idea of an on-line calendar. I have
not decided which one to use yet, so you may see
several different variations. How well it works
will be the deciding factor of whether I implement it
permanently. You can see the calendar on my web
site by clicking HERE or you
can go directly to the calendar by clicking HERE. Keep in mind, the
calendar is located on an outside web site, so you
may end up seeing some ads. I have no control over
that.
For now, I have allowed anyone to make additions.
This web site, my e-mail list/newsletter and this
calendar are for civic purposes only. I do not
accept commercial advertisements and I do not
accept
payment for listing your event. For now, I will
allow civic group to add their events to the
calendar. These events will not show until approved
and I reserve the right to not approve any event. I
will most likely disable that feature in the future
and have users send me the calendar items directly.
To add an event, simply click on the add event

Traffic Update |
| |
Dallas North Tollway - From S.H.
121 to S.H. 380. NTTA continues to
work at a fast pace. The outside Eastbound
Lane on Main Street will
be closed between Dallas Parkway frontage roads
through the end of the month.
The dynamic lane use signs erected for Eastbound
traffic on Main Street now
provide the ability to designate the middle lane as
a right-turn lane during AM
peak and a through lane during the rest of the day.
This sign shows as a
right-turn for now (until the EB Lane is
open).
Illuminated Street Name Signs - As
you have noticed, we started installing
illuminated street signs at traffic signals a few
years ago. This was a pet
project of mine and I asked the City to look at it
in the early years of my
service. You will also notice that Preston
Road does not have these signs
yet. Preston Road is a State Road and Frisco
has asked TxDOT for
permission to put illuminated signs at the
intersections. TxDOT's
structural division is looking at the request and we
hope to get the approval
soon.
Interliga Games at Pizza Hut
Park - Look for special traffic control during
this weekends games.
Traffic Signals:
Coit/Rolator - Completed in December
Custer/Eldorado - Completed in December
Eldorado/Legacy - TxDOT has not submitted a new time
table for this signal.
Legacy/Lakehill - Bid approved by Council on October
17, 2006. Construction anticipated to be completed
by April 2007
Legacy/Academy - Bid approved by Council on October
17, 2006. Construction anticipated to be completed
by April 2007
Legacy/Wakeland - Under Construction and should be
operational soon (I have not checked if it is
on)
Main/Gary - Under Construction and should be
complete by end of January 2007
Main/Independence - This signal is being
reconstructed with widening of
Independent. Reconstruction will be complete by
summer 2007
Main/Trails - Design is complete and is out for bid.
Anticipated construction completion by April
2007
Preston/Meadow Hill - Design began in October 2006.
TxDOT expects to have the temporary signal complete
by Spring 2007 as part of SH 289
Project
Rolater/Independence - Signal will
be constructed as part of widening project.
Anticipated completion of Summer

Teel/Trails Parkway - Design is
complete and is out for bid. Construction is
anticipated to be complete by April

NTTA -
Construction crews for the North Texas Tollway
Authority (NTTA) will reduce the
number of toll booth lanes northbound at the Dallas
North Tollway’s Wycliff Toll
Plaza beginning at 8:00pm on Sunday, January 7,
2007. Four lanes will be open to
traffic at the toll plaza. two cash lanes and two
TollTag lanes. Similar
lane reductions were made southbound at the Wycliff
Toll Plaza in December.
Motorists can expect delays as they approach the
Wycliff Toll Plaza from both
directions. They may choose to seek alternate
routes.

Winter Games of Texas are
quickly
approaching!

Use Hearts and Feet to Fight Cancer
(Frisco, Texas) - Walkers (and joggers) will go
around the clock in the
battle against cancer during the American Cancer
Society Relay For Life of
Frisco.
Teams of Frisco residents will gather at Pizza
Hut Park, Dr. Pink field
on Friday, April 20, 2007 at 7 pm for an
overnight relay against cancer.
Relay For Life is a family-oriented team event
where participants can walk
relay-style around the track and take part in fun
activities off the track.
Teams can include coworkers, club members, family
and friends who have
gathered donations prior to the event.
Teams of eight to 15 members gather with tents and
sleeping bags to
participate in the largest fundraising walk in the
nation. Relay For Life
unites friends, families, businesses, hospitals,
schools and churches ...
people from all walks of life. Teams seek
sponsorship prior to the Relay,
all with the goal of supporting a cure for cancer.
Volunteers are needed to organize and recruit
teams, seek community support,
coordinate logistics, find refreshments and prizes,
plan entertainment and
lend their support in any way.

Charter 101 |
| |
I thought I would include some sections of our City
Charter, as space permits, in my newsletter. Many
of our citizens have never read it and it is the
document that governs how we operate.
SECTION 1.01 Form of Government
The municipal government provided by this Charter,
shall be known as the "Council-Manager Government".
Pursuant to its provisions, and subject only to the
limitations imposed by the State Constitution, the
statutes of this State, and by this Charter, all
powers of the City shall be vested in an elective
council, hereinafter referred to as the "City
Council", which shall enact local legislation, adopt
budgets, determine policies, and appoint the City
Manager, who in turn, shall be held responsible to
the City Council for the execution of the laws and
the administration of the government of the city.
All powers of the City shall be exercised in the
manner prescribed by this Charter, or if the manner
not be prescribed, then in such manner as may be
prescribed by ordinance, the State Constitution, or
by the statutes of the State of Texas.
SECTION 2.01 General Powers of the City
The City shall have all powers and rights of
self-government and home rule that exists now or may
be granted to municipalities by the Constitution and
laws of the State of Texas, unless such power or
right is expressly prohibited or restricted by this
Charter.
SECTION 2.02 Public Improvements
The City shall have the power to, among others,
construct and maintain, within or without its
corporate limits, streets, flood control and
sanitary facilities, water and storm drainage
facilities in, over, under or upon all public
property or easements granted for that purpose and
to levy assessments for the costs of such
improvements. The City shall have the power to
collect attorney's fees for the collection of paving
assessment in foreclosure cases as allowed under
state law. It shall have the power to cause liens to
be established for the purpose of securing the
payment of such levies and shall have the power to
compel the use of such improvements by the citizens
of the City.
SECTION 2.03 Miscellaneous Powers
The City shall have the power to, among others,
establish and maintain ordinances and regulations
governing the use of lands within the City and to
enforce by all lawful means these ordinances and
regulations, within and without its corporate
limits. The City shall have the power to authorize,
regulate and inspect all construction and existing
structures within or without its limits, consistent
with state statutes, and to establish and enforce
ordinances and regulations concerning their use,
construction and reconstruction. The City shall have
the power to license and regulate persons,
corporations and associations engaged in any
business, occupation, profession or trade when
authorized by state law. The City shall have all
powers granted by any section of this Charter.
